Unsolicited Marketing and Fund Raising

Including, but not limited to, text messages, robocalls, phone calls, and emails.

Consent to unsolicited Marketing and Fund Raising is with the specific stipulation that any organization or individual contacting me via any electronic means including, but not limited to, Text Messages, Robocalls, Phone Calls, Emails and or Facsimiles agrees to pay the fees listed on the Rates page. And overview of the aforementioned rates follows:

$250 per unsolicited text message, robocall, phone call, email message or facsimile. This includes but is not limited to communications from politicians, political campaigns, political parties, political surveys, and/or fund raising request asking for donations of any kind.
$125 per unsolicited text message, robocall, phone call, email message and/or facsimile from all other agencies, companies, groups, organizations, subsidiaries and employees of same and/or individuals not otherwise stated.

Receipt of communication from you in the form of text messages, emailing, telephone calls, facsimiles, and/or direct messages on any social media platform that indicates acceptance of the referenced terms and an agreement to pay the amounts indicated on my Rates page. Unless otherwise agreed to in writing, in advance, I do not consent to receiving any electronic marketing or fund raising requests of any kind (non-profit and/or political).

Payment terms are NET 15 calendar days from the date of invoice. Unpaid invoices bear interest at a rate of 1.5% per month, retroactive to the date of invoice. Should you defer from these terms at any time, attorney and related fees will be incurred and are your responsibility for collection of unpaid fees. Any disputes arising from this agreement shall be subject to the jurisdiction of the Florida or federal courts located in Lee County, Florida.

These terms and conditions supersede any and all other agreements that are not signed and notarized by Tim Scoff. Any person, company, or organization violating these terms and conditions agrees that the violation constitutes harassment under Florida Statute Title XLVI, Chapter 784, Section 784.048 by causing substantial emotional distress to Tim Scoff and serves no legitimate purpose. Additionally and in accordance with the CAN-SPAM Act violation of this agreement may subject you to penalties of over $50,000 each.

Any organization, company, or individual who does not agree to and comply with these terms is prohibited from sending text messages, emailing, calling, faxing or initiating any other communication with Tim Scoff except in person or by United States Postal Mail for the purposes of requesting donations, fundraising, marketing, asking survey questions, or selling any products, goods, or services.
